What changes when you are classified as a professional client

Opting up is pitched as an upgrade by the party with a revenue interest in your answer. Here is what leaves when you sign.

Who is asking, and who benefits from the answer?

The offer arrives by email and it is warmly worded. You have been trading actively, your account looks sophisticated, you may qualify for professional status. Keener leverage, a named contact, sizes the ordinary account cannot reach. Nothing in it has to be untrue for it to be interested. The firm writing to you is counterparty to every position you hold.

Professional client is a line in the FCA’s conduct rules. It decides which parts of the rulebook your firm must observe when dealing with you, and it has nothing to do with skill. It is separate from whether HMRC treats your activity as a trade, which nobody elects into. Retail is the default because the rules assume you need what comes with it.

Three tests, and only one goes near what you know

The quantitative side asks you to satisfy two of three conditions. You have dealt in significant size on the relevant market at an average of ten times a quarter across the previous four quarters.

Your portfolio, counting cash deposits alongside financial instruments, exceeds EUR 500,000, a threshold the rulebook still denominates in euros. Or you have worked in the financial sector for a year in a role requiring knowledge of the transactions concerned.

Read them for what they measure. The first counts activity, the second counts money, and only the third comes near competence, accepting a year of adjacent employment as a stand-in for the knowledge. Somebody dealing ten times a quarter with half a million euros clears the bar without anyone establishing they have thought about a weekend gap. Frequency and wealth are the qualifications.

The signature that works in both directions

The tests are not the whole procedure. The firm must assess your expertise, experience and knowledge, and satisfy itself you can take your own investment decisions and understand the risks. You then write asking to be treated as professional, the firm warns you in writing of the protections you may lose, and you countersign a document kept separate from the account contract.

That separate document is the most revealing object in the process. It exists because whoever drafted the rule expected the acknowledgement to disappear into terms and conditions if allowed to live there. It is equally the firm’s evidence that you were told. The signature protecting you from not knowing is the one protecting the firm from your saying afterwards that you did not.

The five rules that stop applying to you

The CFD regime was written for retail clients and nobody else, so opting up changes which of its parts still bind the firm when it deals with you. Cosmetically nothing moves. The leverage ladder goes first, every rung of it, and the table below sets out what each rung was. What replaces the ladder is not another ladder. It is whatever the firm decides to offer you, revisable by the firm, at the firm’s convenience. Close-out at half your required margin, negative balance protection, the inducement ban and the standardised risk warning all stop with it.

Protection  While you are retail  After you opt up  Who carries what it covered
Leverage caps  30:1 major FX, 20:1 gold and major indices, 5:1 shares, 2:1 crypto CFDs  No cap in the rules  You, at whatever multiple the firm extends
Close-out at 50% of margin  Mandatory close-out at half the required margin  No mandated trigger  You, until the firm’s own policy stops you
Negative balance protection  Losses cannot exceed the account balance  Withdrawn  You, for any gap beyond your balance
Ban on inducements  No benefits offered to get you dealing  Lifted  You, once an incentive becomes a reason to deal
Standardised risk warning  Promotions carry the firm’s share of loss-making retail accounts  Not required  Nobody: the figure is no longer shown to you
FSCS cover, GBP 85,000  Set per client per firm by the compensation rules  Unchanged for an individual  Unchanged, worth confirming in writing

Six protections, set out as they stand for a retail client and as they stand once the classification changes.

Nobody funds an account to find out what the other tier costs

There is a research problem here, and it lands on the research as squarely as on you. Testing a UK platform by funding a live account produces figures recorded under retail terms, because a genuine new customer is a retail customer. Pricing the other tier the same way would mean opting the testing accounts up and surrendering the same five protections.

So a page about professional accounts is written from outside the category, out of terms documents and firms’ own wording, while the pages either side rest on money that actually moved. That seam should be visible and usually is not.

Coverage of professional CFD accounts at theinvestorscentre.co.uk/trading/best-cfd-trading-platform-uk/professional-traders/ sits on a site that opens and funds live accounts with its own money to test UK trading platforms rather than compiling rankings from providers’ published fee schedules, and the honest reading is that the method reaches the retail tier and stops.

Each of the five was written against something that had already happened

None of the five was drafted in the abstract. Each is aimed at a specific way retail accounts had been observed to come apart: sizes nobody could survive, positions left open past the point of recovery, debts owed to a firm after the money had gone, incentives paid for dealing, and promotions that mentioned the upside without the arithmetic. Read the list as case notes and it stops looking like paperwork.

Seven in ten, with every protection switched on

Which reframes the decision usefully. Published loss rates across UK CFD firms sat in the 78% to 82% range before the intervention, and an index of fourteen FCA-authorised UK CFD brokers compiled in April 2026 puts the mean at 69.9% and the median at 71.0%.

Whether the rules did that is a question nobody outside can settle, and setting a 2026 sample against a pre-2019 era measures the decade as much as the rulebook, so the figure worth carrying is the level. Seven in ten still lose with every protection switched on, and that is the population you would be leaving.

The firm is not neutral about which box you tick

Work out what the other party gains. More leverage on the same deposit means larger notional positions, and revenue on a CFD is earned on notional. Doubling the multiple a client can reach does not double their capital; it doubles the size on which spread is taken and financing accrues. Negative balance protection is insurance the firm writes for nothing, and reclassification cancels it.

One signature removes you from the number in the warning

A second effect almost nobody raises. The standardised warning quotes a percentage of retail client accounts losing money at that firm, so reclassifying a client removes that account from the population the figure is calculated across. You stop seeing the warning and the firm stops counting you inside it, from one signature. Which way that moves the number is unknowable from outside, since the tests select a well-capitalised, high-frequency group whose outcomes nobody publishes.

Before you countersign

None of this makes the offer a trick. Some clients want size the retail regime will not extend, and the category exists because the regulator accepts that. If you are hedging an exposure that sits outside the trading account, most of what you surrender is protection you were never going to call on. That group knows who it is without an email telling it.

Everybody else should notice the asymmetry. You can ask to move back to greater protection, but nothing obliges anyone to prompt you, and the duty to report a change in circumstances runs from you towards the firm. The tests you passed are checked once; the protections you gave up are gone every day afterwards.

So put two questions in writing first, both about what the rules stop deciding: what leverage will actually be extended on the instruments you trade, and what the firm’s own close-out policy becomes once the mandated trigger no longer applies. Both answers turn discretionary the moment you countersign, and a discretion is easier to read before somebody is exercising it against you.
